Terms of Service

1. Acceptance

By creating an account or using Jobby.dev (“Jobby”, “the Service”) you agree to these Terms, our Privacy Policy, and our Cookie Policy. During signup you must explicitly accept these Terms and our Privacy Policy via the consent checkbox. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 18 years old and have the legal capacity to enter into a binding agreement. By using Jobby you represent that you meet these requirements. Jobby is not directed at children under 16.

3. Accounts

  • You are responsible for maintaining the confidentiality of your login credentials.
  • You must provide accurate and complete information when creating an account.
  • One person may not maintain more than one account of the same role.
  • Notify us immediately at hi@jobby.dev if you suspect unauthorised access.

4. Acceptable use

You agree not to:

  • Misrepresent your identity, qualifications, or job opportunities.
  • Harass, abuse, or harm other users during interviews or any part of the platform.
  • Scrape, copy, or redistibute platform data without written permission.
  • Use the Service for any unlawful purpose or in violation of any regulations.
  • Attempt to reverse-engineer or interfere with the platform's infrastructure.

5. Subscriptions and billing

  • Job seekers use Jobby free of charge.
  • Recruiters may access the Service under a free trial or a paid subscription plan.
  • Paid plans are billed monthly in advance. Prices are listed on the Pricing page and may change with 30 days' notice.
  • Overages beyond your plan's included minutes are billed at the rate shown on the Pricing page.
  • Refunds are not provided for partial billing periods or unused minutes, except where required by law.

6. Intellectual property

All content, trademarks, and software comprising Jobby are owned by or licensed to Jobby.dev. You retain ownership of content you upload (e.g. resumes). By uploading content you grant Jobby a limited licence to store, display, and process it (including via third-party AI services as described in our Privacy Policy) solely to operate the Service.

7. AI features & third-party processing

Certain features of the Service use artificial intelligence provided by third-party services (currently Anthropic). By using these features you agree that:

  • Content you provide (such as resumes, job descriptions, and interview data) may be sent to third-party AI providers for processing.
  • AI-generated outputs (including but not limited to match scores, parsed profiles, report cards, candidate evaluations, and co-pilot suggestions) are provided for informational and convenience purposes only. They may be inaccurate, incomplete, or misleading. You acknowledge that AI outputs may contain errors and agree not to rely on them as the sole basis for hiring, employment, or any other consequential decisions. Jobby disclaims all liability for losses or damages arising from reliance on AI-generated content.
  • We do not control and are not responsible for how third-party AI providers or other service providers handle your data beyond our contractual agreements with them. We encourage you to review their respective privacy policies. You acknowledge that transmitting data to third-party services carries inherent risks.
  • We may change AI providers or other service providers at any time without notice. We will update our Privacy Policy to reflect material changes.

8. Data sharing & sale

  • By using the Service you acknowledge and agree that your data (including profile information, usage data, and aggregated or de-identified data) may be shared with third-party service providers for the purposes of operating, improving, and marketing the Service, as described in our Privacy Policy.
  • We reserve the right to share, license, or sell aggregated, de-identified, or anonymized data that does not personally identify you, for any purpose including commercial purposes, without further notice or compensation to you.
  • In the event of a merger, acquisition, bankruptcy, or sale of all or a portion of our assets, your personal data may be transferred to the acquiring entity. We will notify you via email and/or a prominent notice on the Service before your personal data becomes subject to a different privacy policy.
  • We may also disclose your data where required by law, regulation, legal process, or governmental request.

9. Your data & privacy rights

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, share, and protect your data, and explains your rights under GDPR, UK GDPR, CCPA/CPRA, and other applicable privacy laws.

  • Account deletion: you may delete your account at any time from your Privacy Settings. Upon deletion your data is anonymised immediately and permanently purged after a 30-day grace period.
  • Data export: you may export all of your personal data at any time from your Privacy Settings in a machine-readable JSON format.
  • Marketing communications: you may opt in or out of marketing emails at any time from your Privacy Settings. We will always honour your preference.

10. Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind, whether express, implied, or statutory. Jobby expressly disclaims all warranties including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Without limiting the foregoing:

  • Jobby does not warrant the accuracy, reliability, or completeness of any AI-generated content, including match scores, parsed profiles, report cards, or any other automated output. AI features may produce errors, omissions, or biased results. You assume all risk associated with reliance on such outputs.
  • Jobby does not guarantee that you will find a job or hire a candidate through the platform.
  • We are not responsible for the conduct of users during interviews or any other interactions facilitated by the platform.
  • Jobby does not warrant that the Service will be uninterrupted, secure, or error-free, or that defects will be corrected.
  • Jobby is not responsible for the acts, omissions, or policies of any third-party service provider, including AI providers, hosting providers, and payment processors.

11. Limitation of liability

To the fullest extent permitted by law, Jobby's total liability to you for any claim arising from use of the Service is limited to the amount you paid us in the 12 months preceding the claim, or $100 USD, whichever is greater.

12. Termination

We may suspend or terminate your account at our discretion, with or without notice, if you violate these Terms. You may delete your account at any time from your Privacy Settings or by emailing hi@jobby.dev. Upon termination, Sections 6–11 and 13 survive.

13. Governing law

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict of law principles.

14. Changes

We may update these Terms. We will notify registered users by email of material changes at least 14 days before they take effect. Continued use after the effective date constitutes acceptance.
